The online store is operated at www.padelcrush.eu (the Store).

2. Scope and acceptance of these Terms

2.1. These Terms and Conditions govern the rights, obligations, and liability of the Seller and the buyer (the Customer) when purchasing goods in the Store.

2.2. By placing an order, the Customer confirms that they have read and agree to these Terms and Conditions as well as the Returns & Refunds Policy, the Privacy Policy, and the Cookie Policy.

2.3. The Seller may update these Terms. The version in force at the time the order is placed applies to that order.

3. Account, age, and responsibility

3.1. The Customer is responsible for maintaining the confidentiality of their account credentials.

3.2. The Customer confirms they are at least 18 years old or have the consent of a legal guardian.

4. Products, pricing, and discounts

4.1. Product features, included items, and prices are displayed on each product page. Prices are shown in EUR and include VAT. Shipping fees are shown separately before the order is confirmed.

4.2. Discounts are presented in accordance with applicable legal requirements, including indicating the previous price (the lowest price in the last 30 days) or the price before the first reduction in the case of progressive reductions. If a product has been sold for less than 30 days, the lowest price during the selling period is indicated.

4.3. Obvious technical errors (e.g., an incorrect price) are considered non-binding. In such cases, the Seller has the right to cancel the order and refund all payments made by the Customer.

5. Contract formation and order fulfilment

5.1. By adding products to the cart, selecting delivery and payment, and confirming the order, the Customer enters into a distance sales contract with the Seller.

5.2. The order is deemed accepted for fulfilment once the Seller confirms it by email or starts fulfilment (e.g., hands the parcel over to the carrier).

5.3. If an item is out of stock or the order cannot be fulfilled, the Seller will inform the Customer without undue delay and refund any payments received.

6. Payments

6.1. Payments are processed via third-party payment service providers (cards, online banking, etc.).

6.2. A payment is considered received once it has been successfully confirmed.

7. Delivery and transfer of risk

7.1. Delivery methods and indicative delivery times are provided in the Shipping Policy and/or displayed in the cart before payment.

7.2. The risk of accidental loss of or damage to the goods transfers to the Customer when the goods are physically received by the Customer. If the Customer chooses their own carrier that is not offered by the Seller, the risk transfers when the goods are handed over to that carrier.

7.3. Upon receiving the parcel, the Customer should inspect the packaging. If damage is noticed, the Customer should note it in the carrier’s documents (where possible) and notify the Seller within 24 hours.

8. Right of withdrawal (14 days)

8.1. A consumer (a natural person purchasing for purposes outside their trade, business, craft, or profession) has the right to withdraw from the distance contract within 14 calendar days from the day of receiving the goods, without giving any reason.

8.2. The withdrawal procedure, return conditions, refund method, and timelines are set out in the Returns & Refunds Policy.

8.3. Exceptions: the right of withdrawal does not apply to personalized goods, fully performed services provided with explicit consent (e.g., racket stringing), sealed hygiene goods if the seal is broken, and other cases provided by applicable law.

9. Non-conformity and legal guarantees

9.1. Goods are covered by a 2-year statutory legal guarantee of conformity from the date of delivery, in accordance with applicable law.

9.2. In the event of non-conformity, the Customer has the right to request free repair or replacement, and where that is not possible, a price reduction or termination of the contract and a refund.

9.3. Submitting a complaint: email info@padelcrush.eu (please include order number, description, photos/videos). We will respond within 14 calendar days.

10. Gift cards

10.1. The validity period and usage rules for gift cards are specified in the gift card terms.

10.2. Gift cards are not exchangeable for cash, unless required by applicable law.

11. Promotions, discount codes, and reviews

11.1. Where promotional offers apply, the previous price is displayed in accordance with legal requirements.

11.2. Discount codes apply subject to the stated conditions; they are not applied retroactively; and they may not be combined with other offers unless stated otherwise.

11.3. Reviews are published only from genuine customers; moderation may be applied (e.g., removal of unlawful or inappropriate content).

12. Intellectual property

12.1. All rights to the Store content (trademarks, texts, photos, design) belong to the Seller or are used lawfully.

12.2. Copying, using, or distributing content for commercial purposes is prohibited without prior written consent.

13. Prohibited activities

13.1. When using the Store, it is prohibited to: violate laws; provide misleading information; attempt to bypass security systems; distribute malware; or engage in activities that could harm the Store or other users.

14. Limitation of liability

14.1. To the extent permitted by applicable law, the Seller is not liable for indirect damages (loss of profits, loss of reputation, etc.). This does not limit the Customer’s statutory consumer rights or the Seller’s liability for intentional misconduct or gross negligence where such limitation is not permitted by law.

15.2. If the dispute cannot be resolved, consumers may contact the Lithuanian State Consumer Rights Protection Authority (VVTAT) or use other dispute resolution options available under applicable law.

16. Governing law

16.1. These Terms are governed by the law of the Republic of Lithuania.
